The purpose of these general conditions is to define the rights and obligations of the parties in connection with the online sale of goods offered by Jojoba Gold to the consumer.
Jojoba Gold authorizes itself the right to modify at any time the content and the form of these general conditions of sale.
- PROTECTION OF PERSONAL DATA
All personal data will be considered confidential.
The information necessary for order management will be subject to computer processing and may be communicated to associated companies within the framework of order management.
Jojoba Gold undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to treat it according to legal obligations.
Jojoba Gold transmits personal data to third parties only to the extent that they are essential for the proper execution of the Order.
No data will be transmitted to third parties for commercial purposes.
Customer data may be used by internal Jojoba Gold services for processing orders, deliveries and invoices.
- PROCESS OF ORDERING-ON-LINE
Once the desired product is selected, it is placed in the “shopping cart” by the “Add to cart” button. The customer can then continue his selection of items, modify his shopping cart or continue the ordering process and pay.
The validation of the order by the customer takes the place of acceptance of the general conditions of sale.
- ORDER CONFIRMATION
The selected order is completed when the customer presses the button for the chosen payment method on the page for choosing the payment method.
Jojoba Gold confirms the acceptance of the order as well as its evolution to the customer, to the e-mail address that he will have provided when registering on the site.
This confirmation is effective when the customer receives an e-mail from Jojoba Gold indicating that the order has been placed in “Order processing” or “Delivered” status.
This e-mail thus forms a sales contract between the customer and Jojoba Gold.
Jojoba Gold reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order.
In the event of an error in the wording of the recipient’s contact details, Jojoba Gold cannot be held responsible for the impossibility in which it could be to deliver the product (s) ordered.
Once the order is completed, the customer receives information about the order confirmation by e-mail.
The contractual information will be confirmed by email to the address indicated by the consumer in the order form.
- ACCEPTANCE OF THE ORDER
Acceptance of the order is made upon receipt and control of its validity.
By checking the box, “I have read the general conditions of sale and I adhere to them without reservation. (Read the General conditions of sale) »when choosing the delivery method, the buyer automatically acknowledges having read the general conditions of sale and accepts them.
- VALIDITY OF INFORMATION PROVIDED
The Customer of the site www.jojobagold.ch undertakes to provide real, exact, up-to-date information at the time of their entry in the service registration form.
If the customer has supplied incorrect information, Jojoba Gold declines all responsibility in the absence of delivery, total or partial, of the Products ordered by the Customer, as well as for undelivered notifications sent to the customer by e-mail.
The prices mentioned by article on the E-Commerce site are indicated in Swiss francs including VAT 7.7% and excluding costs of preparation or logistics delivery.
The shipping costs of the order will be indicated before the final validation of the order.
Jojoba Gold reserves the right to modify the prices and other costs displayed on the E-Commerce site without notice at any time. However, the products will be invoiced to the customer on the basis of the prices in force at the time of validation of the order.
Articles benefiting from a guarantee are subject to the conditions of the offer valid at the time of purchase.
The guarantee takes effect on the date of delivery of the article, justified by the accompanying document which we ask you to keep carefully.
Our delivery commitment is void in the event of failure or non-compliance with supply deadlines from our own suppliers, and insofar as this unavailability is not attributable to Jojoba Gold.
If a product is unavailable, we will notify you as soon as possible.
- SECURE PAYMENTS
For the payment of the order, are accepted:
– Bank transfer
Payment for purchases is made on the secure bank or postal servers of Jojoba Gold partners, as mentioned above. This implies that no banking or postal information concerning the Client passes through the Jojoba Gold website.
Payment by bank or postcard is therefore perfectly secure.
- DELIVERY AND TRANSPORT
Jojoba Gold collaborates with Swiss Post for the delivery of products. Deliveries are limited to Swiss territory. We do not deliver abroad because we focus on our core market: the Swiss market.
Delivery by Swiss Post, economy against signature. The signature will assure you that your package will be delivered to you by hand.
Jojoba Gold cannot offer any type of urgent delivery because we have a contract with the Swiss Post only for deliveries twice a week: every Tuesday and Friday.
There is no delivery on Saturday, Sunday, national and cantonal holidays.
The day of shipment of your order an automatic email will be sent to you. This email will also contain a link which will allow you to follow the progress of your parcel with the Swiss Post.
If the information provided by the Customer during the order process is inaccurate, our company cannot be held responsible for the impossibility of respecting the delivery time.
In the event of a delivery problem with La Poste, our company assumes no responsibility.
10.1. UNCLAIMED PACKAGE
If a package is not claimed by the client, we will be billed by the carrier for the shipment of the package to the client and then for the return of the package to our depot. We will therefore be forced to pass on all of these costs to the client.
In the absence of the Customer during the delivery man’s delivery, the package will be kept at the local La Poste office for 10 days. La Poste will leave the notification in a customer mailbox with the possible dates of withdrawal of the package directly from the Post.
If the Customer is not available at the delivery address during the day, he can call the office
Local Post Office and ask to send the package to its address without asking for a signature. However, if the package is stolen from the mailbox, the customer assumes full responsibility.
Jojoba Gold is not responsible if the customer has not received his package within 10 days from the date of receipt by post and the package has been returned to Jojoba Gold.
To return the package to the customer, Jojoba Gold has the right to request payment for the return of the package and for its repeated shipment. Or Jojoba Gold will pay the customer the cost of the order less the cost of the initial delivery, as well as the cost of returning the package.
In the event of a delivery problem with Swiss Post, our company accepts no liability.
10.2. DELIVERY CONTROL
Upon receipt of the goods, the customer must check whether the products, condition and quantity correspond to the order. Defects found during regular inspection of the goods and deliveries of goods or quantities other than those ordered must be the subject of a complaint by e-mail to firstname.lastname@example.org WITHIN 7 DAYS after receipt of the delivery.
If the customer fails to claim within the time limit, the goods are considered to have been accepted. Claims do not release from the obligation to pay.
10.3. DAMAGE DURING DELIVERY
If, unfortunately, the goods will arrive at the customer’s home in poor condition, the transport damage must be announced IMMEDIATELY to the carrier when the latter makes the delivery, failing which the customer takes care of his charges the responsibility for any damage to the goods.
It will then suffice for the customer to send us a return request with an official statement from the carrier (Post Office), wait for our agreement and then return the damaged goods to us.
Defective and warranty products will in all cases be replaced by a new and identical product, unless the product in question is no longer available, in which case a credit note or a replacement item will be offered to the customer.
10.4. DELIVERY ERRORS
Any goods delivered in error or in excess must be returned immediately, or at the latest within 7 days. In case of non-return, the goods will be invoiced.
- SHIPPING COST
Shipping costs are not included in the prices of the Products as displayed on the pages of the site www.jojobagold.ch describing the Products. However, at the time of validation of the order, the price will include the costs relating to the delivery of the Products.
The cost of the additional service (IS) – the Signature request – is not included in the delivery cost for customers. Jojoba Gold pays for this service as a guarantee of safe delivery.

Up to 2 kg: CHF 10.00
Up to 5 kg: CHF 14.00
Up to 10 kg: CHF 18.00
Up to 20 kg: CHF 25.00
Up to 30 kg: CHF 30.00
The cost of delivery includes:
– Cost of labor to pack your package
– Cost of cardboard
– Cost of packaging materials
– Cost of the label
– Cost of scotch
– Cost of delivery note pocket
- RETURNS, WITHDRAWAL AND REFUNDS
From the receipt of the product by the customer, the latter has a right of withdrawal, that is to say a period of 14 days to return the delivered product, the return costs being borne by him.
Only products purchased through the E-Commerce site, and returned with their individual protective packaging intact (unopened and in their original packaging) may be subject to a refund.
The procedure to follow is as follows:

The product must be accompanied:
– Order number
– The name of the person who returns the order
The product will be checked by Jojoba Gold service which will validate or not the refund, in particular by verifying that the product has been returned complete and in a condition suitable for re-marketing, as provided for in the right of withdrawal.
If the merchandise meets the return requirements, it may be subject to a refund or an exchange.
If the merchandise does not meet the return requirements, it will be returned to the customer who will not be able to obtain a refund.
- APPLICABLE LAW
These general conditions of sale, as well as any sale to which they apply, are subject to Swiss law.
Any dispute arising out of, or in connection with these general conditions of sale or any sale to which these apply, will be settled according to Swiss law, whether this dispute is of a contractual or tort nature, or whether it is based on another clause.
The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. The exclusive place of jurisdiction is in Fribourg, Switzerland.
- ORIGINAL TEXT
Jojoba Gold’s general conditions are written in French, English and German. In case of contradiction, the French version prevails.
- LEGAL GUARANTEES
Check the condition of the goods delivered without delay to exclude obvious defects in material and workmanship, as well as damage due to transport.
In accordance with the law, you are obliged to notify us of any defect or anomaly affecting the goods delivered so that we can remedy them.
